Learned counsel for the petitioners seeks leave to withdraw this petition with liberty to file appropriate application before the Tahsildar, Pune, for grant of caste certificate claiming themselves to be belonging to the caste Koli.

2] According to the learned counsel for the petitioners earlier a claim was made by the petitioners that they are belonging to caste Mahadev Koli which was rejected. In the circumstances the petitioners are intending to file the application claiming themselves to be Koli which according to the petitioners is their actual caste. 1/2

skc 2 22-WP-7422-15.sxw 3] Without commenting upon the merits of the matter and the petitioners' entitlement, we dispose of the petition with liberty to the petitioners to file appropriate application before the Tahsildar, Pune / Competent Authority for issuance of caste certificate. On receipt of such application, the Tahsildar / Competent Authority shall examine the same and shall take appropriate decision on it in accordance with law after giving due opportunity of hearing to the petitioner. The decision as aforesaid to be taken within three months from receipt of such application.

4] Petition is disposed of accordingly.
