The learned Counsel for the petitioners placed on record a communication dated 31st May 2018 addressed by the Commissioner, Kalyan-Dombivali Municipal Corporation to Mr.K.T. Jitendran. He submits that a Letter of Intent has been issued. The Corporation has given Accommodation Reservation which according to the learned Counsel is a layout approval.

In view of this communication, on instructions, the learned Counsel

2/2 901-wp 7028-16.doc for the petitioners seeks leave to withdraw this petition with liberty to approach this Court in case the Corporation fails to issue commencement certificate within reasonable time.

The Counsel for the KDMC is present and submits that there is no objection to grant leave to withdraw the petition. 4.

With aforesaid liberty, leave to withdraw the petition is granted. 5.

Petition is disposed of as withdrawn.
