The Applicants are seeking anticipatory bail in connection with C.R.No.212/2024 registered at Vadgaon Nimbalkar Police Station, District-Pune on 4.4.2024 under Sections 143, 147, 307, 148, 149, 324, 323, 504, 506, 120-B of IPC.

Heard Mr. Shailesh Chavan, learned counsel for the Applicants and Ms. Rajeshree Newton, learned APP for the Respondent-State.

The FIR is lodged by one Vishal Salve. He has stated that there were two groups who wanted to celebrate the festivals separately. There was competition between the two groups. The incident occurred on 3.4.2024. The Applicants belonged to the opposite group of the informant. It is alleged that they called the informant to Malivasti at about 10.20 p.m. The present Applicants and other 3-4 named accused were present there. Some of them were having rods and some of them were having sticks. They all assaulted the informant. The accused Vikram, Aryan and Rohan assaulted him with iron rods on his head. The others, including the present Applicants, assaulted him with fist and kick blows. On these allegations, the FIR is lodged.

Learned counsel for the Applicants submitted that even as per the FIR, the Applicants were not carrying any weapon. The informant has not suffered any serious injuries. The allegations in the FIR are false. In any case, they are exaggerated. Learned APP produced the investigation papers and produced the injury certificates.

I have considered these submissions. The injury certificate of the informant mentions that he had suffered one tiny abrasion on the left side of the forehead. There was another tiny abrasion on left eye-lid and there were multiple small abrasions on both lower legs. The medical certificate describes the injuries as simple injuries. There is record of private hospital. There also the medical papers do not show any grievous injury. 6.

In this view of the matter, the Applicants can be protected under Section 438 of Cr.P.C.. Their custodial interrogation is not necessary.

Hence, the following order :

ORDER

(i) In the event of their arrest in connection with C.R.No.212/2024 registered at Vadgaon Nimbalkar Police Station, District-Pune, the Applicants are directed to be released on bail on their furnishing PR bonds in the sum of Rs.30,000/- each (Rupees Thirty Thousand Only) with one or two sureties each in the like amount. (ii) Anticipatory Bail Application stands disposed of accordingly.
