The learned counsel for the petitioners on instructions seeks permission to withdraw this petition with liberty to file an application for allotment of a suitable land at village Kumbhavali, Taluka Palghar, District Palghar. He states that the application will be made within a period of one month from today.

Hence, we dispose of the petition by passing the following order:

(I) Writ petition is disposed of as withdrawn with liberty as prayed;

wp5869 (II)If the petitioners make an application for allotment of suitable land at village Kumbhavali, Taluka Palghar, District Palghar within a period of one month from today to the Collector, appropriate decision shall be taken by the Competent Authority on the said application as expeditiously as possible and in any event within a period of three months from the date on which application is made;

(III) All contentions on merits are kept open.
