The learned counsel for the applicant submits that there is a delay of 192 days in filing First Appeal. He relies on the reasons mentioned in the application.

This appeal is pending since 2008. Though the applicant/insurance Company is served on respondent no.1, who is main contesting party, respondent no.1 is not present. 4.

In view of uncontroverted submissions and the reasons mentioned in the application, delay is condoned. Civil Application is allowed.

The applicant/insurance Company is directed to serve the respondents. Private service is allowed. The insurance Company to serve copy of the relevant documents to the respondents. 6.
