The applicants have been convicted by the Learned Judicial Magistrate First Class, Court No.1, Kolhapur for the offences punishable under section 420, 467, 468 r.w.s. 34 of IPC and sentenced to suffer rigorous imprisonment for six months and to pay fine of Rs. 5,000, on each count, with default stipulation. The Criminal Appeal No. 64 of 2013 preferred by applicants against the said order of conviction and sentence came to be dismissed by the Learned Sessions Judge, Kolhapur by judgment and order dated 26th March, 2019.

Having regard to the quantum of sentence imposed by the Learned Judicial Magistrate First Class, Court 1, Kolhapur and confirmed in appeal by the Learned Sessions Judge, Kolhapur, and the situation in life of the applicants, the substantive sentence imposed by the Learned Judicial Magistrate First Class in Regular Case No.568 of 2001 and confirmed by Learned Sessions Judge in Criminal Appeal No. 64 of 2013 stands suspended till the decision of this Revision Petition and the applicants are directed to release on bail on furnishing a PR Bond of Rs.10,000/- and one or two sureties in the like amount, each.
