DATED : 28th JUNE, 2022 P.C:- Considering the accusations levelled against unknown persons, which according to the prosecution, are the present applicants, and on consideration of the nature of injury reflected in the certificate issued by Axis Orthopedic Hospital on 3/5/2022, the applicants deserve to be released on bail in connection with C.R.No.342/2022. The C.R. invoke Section 307, 323, 326, 427 r/w Section 34 of IPC, in the backdrop of the narration in the complaint.

When the complaint is carefully perused, one Akshay is alleged to have assaulted the complainant in his face by means of a cement pebble which caused fracture of his skull. The Tilak

2/2 49 BA 1843-22.doc accused Sandesh Patil and one unknown person is alleged to have assaulted him by means of fists and blows and slapped him on his face. The applicants are not named by the complainant and considering the limited role attributed to them, they deserve their liberty. Hence, the following order :-

O R D E R

(a) The Applicant no.1 - Shashi s/o Ramashankar Pandey & applicant no.2 Indrabahadur @ Monu Samarbahadur Singh, in connection with C.R.No.342/2022 registered with Bangur Nagar Police Station shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- each with one or two sureties of the like amount. The applicant may be granted provisional cash bail of Rs.25,000/- each for a period of three weeks.

(b) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer. The Applicants should not tamper with evidence.

(c) The Applicants shall attend the trial on all dates unless exempted.
