The Petitioner who is present in the Court when confronted, denied his relationship with real sister viz., Manjusha, however, upon further confrontation through his counsel, has admitted his blood relation with Manjusha who holds a validity certificate as belonging to Koshti SBC.

In the abovesaid background, particularly having regard to the relationship being not disputed by the Petitioner, this Court was not inclined to entertain the petition and was to dismiss the same with exemplary cost and further criminal prosecution of the Petitioner for making incorrect statement before this Court. the fact that the Petitioner has already retired for the services, we refrain from passing an order of prosecution against the Petitioner. Considering the aforesaid (mis)conduct of the Petitioner, who is from the pious field of teaching, the petition is dismissed with cost of Rs.50, 000/- [Rupees Fifty Thousand only] to be paid to the High Court Legal Services Committee, Mumbai within four weeks from today.

The Petitioner shall produce copy of payment of cost before the Registrar (Judicial-II). We direct Registrar (Judicial-II) that in case of failure of Petitioner to deposit the cost as directed, let there be revenue recovery proceedings under the Maharashtra Land Revenue Code, 1966 against the Petitioner for recovery of amount of cost. We direct concerned Tehsaildar to place compliance before us within four months from the receipt of communication from Registrar (Judicial-II). [Sharmila U. Deshmukh, J.] [Nitin W.
