The Petitioner made an Application before the Scheduled Tribe Scrutiny Committee, Nashik praying for discarding the vigilance cell report dated 12th April 2016 and written submissions filed on 25th October 2016 by the Complainant who is the second Respondent in this Petition. There was another Application made by the said second Respondent for proceeding with the complaint on the basis of the vigilance cell report. The Application made by the

sng wp-8077.17 Petitioner has been rejected by the impugned order. The Application made by the second Respondent on 17th November 2016 was allowed. The order impugned is purely of interlocutory nature. In the event, the final order passed by the Caste Scrutiny Committee is adverse to the Petitioner, the Petitioner can always challenge the impugned order while filing appropriate proceedings for challenging the final order.

Therefore, at this stage, when the inquiry is pending before the Caste Scrutiny Committee, no interference is called for in writ jurisdiction of this Court under Article 226 of the Constitution of India. 3.

Subject to what is observed above, the Petition is disposed of. We make it clear that we have not made any adjudication on merits of the impugned order.
