Heard learned A.G.P. Mr.Patil for the applicant. This application is for condonation of 116 days delay in filing the first appeal. The respondents are duly served. No one appeared on behalf of them when the matter is called out.

2) Considering the submissions made by the learned AGP Mr.Patil and the averments made in the application, I satisfied that the applicant has made out the case for allowing the civil application. Hence, following order.

a) Civil Application is allowed and the delay in filing the first appeal is condoned.

Civil Application is disposed of accordingly.

ASN 2/2 CA1723-13(21) First Appeal Stamp No.15669 of 2010 Not on board. At the request of the AGP. Mr. Patil matter is taken on board for admission. This first appeal is preferred by State of Maharashtra challenging the Judgment and Award dated 13.11.2009 passed by District Judge 1 Gadhinglaj in Land Reference No.132 of 1999.

2) Admit.

3) Appellant to file private paper book within one year from today failing which first appeal shall stand dismissed without referring back to the court.
