This is an application for grant of bail during pendency and final disposal of Criminal Appeal No.576/2022. 2.
Both the applicants were convicted and sentenced by Adhoc Assistant Sessions Judge, Sessions Court, Greater Mumbai vide judgment and order dated 25.1.2022 passed in Sessions Case No.1854/2019. The applicants were convicted for commission of yhe offences punishable under Sections 353, 332, 504 read with 34 of IPC and under each of these heads they were sentenced to suffer SI for six months. Heard Shri Priyatosh Tiwari, learned counsel for the applicants and Smt. J.S. Lohokare, learned APP for the State. 4.
The applicants are ladies. They were on bail during trial. After conviction, they were granted interim bail under Section 389 of Cr.P.C.. There are no allegations of any untoward incident misusing the liberty granted to them. The sentence imposed is only for six months. Within that period, the appeal is not likely to be decided. Therefore, the applicants can be released on bail during pendency of the appeal. Hence, the following order :
:: O R D E R ::
i. During hearing and final disposal of Criminal Appeal No.576/2022, the applicants are directed to be released on bail on their furnishing P.R. bonds in the sum of Rs.30,000/- each (Rupees Thirty Thousand Only) with one or two sureties each in the like amount.
