Heard the learned counsel for the petitioner. By this petition under Article 227 of the Constitution of India, petitioners defendants challenges the order dated 28.4.2014 passed by Civil Judge, Junior Division, Rajapur below Exhibit-39 in Regular Civil Suit No.69 of 2012 allowing plaintiff's application for appointment of Court Commissioner to do auction of Mango fruits standing on the suit properties for the year 2014's season.

As 2014 season is already over, nothing survives in the present petition. Petition stands dismissed as infructuous.

All contentions of both the parties are kept open in case fresh application is filed for subsequent season.
