After order of rejection passed by this Court on 14/01/2019 on the merits of the matter, applicant-accused has taken his chance before the Apex Court through Special Leave to Appeal (Crl.) No. 1944/2019. The Apex Court vide order dated 01/03/2019 permitted the applicant to withdraw the bail application as dismissed with liberty to petitioner to approach the High Court in case there is delay in trial.

2 6.1424.19 ba.doc Applicant is unable to demonstrate that there is delay in trial. Rather while responding the submissions, learned APP has pointed out that the accused are delaying the trial by taking adjournments before the Trial Court. It is not in dispute that some of the accused are related to the applicant.

As such, it will be in the interest of applicant himself to cooperate with the Trial Court in expeditious disposal of the trial. As such, application stands rejected.

Trial is expedited. Needless to clarify that Trial Court shall not grant adjournment to accused on fimsy grounds. [NITIN W. SAMBRE, J.]
