The application is filed for condonation of delay of 17 days in filing the appeal. Learned Counsel for the Respondent No.1 opposes the application and submits that the delay is not of 17 days. He would submit that though the order dismissing the suit for default was passed on 18th November 2015, the application for certified copy was filed after the expiry of period of limitation for filing the reply. 2.

Be that as it may, considering the nature of order that I am proposing to pass in the main appeal, the delay in filing the appeal is condoned.
