Apprehending arrest in the Crime NO.158 of 2019 registered with Bhandup Police Station for the ofences punishable under Section 326, 324, 323 read with Section 34 of the Indian Penal Code, 1860, applicant is seeking prearrest bail. Pending application, this Court vide order dated 18th June, 2019, granted interim protection to the applicant on the condition that he shall report to the Investigating Officer on 21st and 22nd June, 2019.

The learned APP on instructions submits that material collected during the investigation has not disclosed commission of offence under Section 326 of the IPC. He has placed on record communication to that efect addressed to the office of the PP by the Sr.P.I. Bhandup Police Station.

In view of the facts of the case and in terms of the communication dated 10th November, 2019 (copy of which is taken on record and marked X-1 for identification), Application is allowed and hence, the order:

(I) In the event of arrest, applicant shall be released on executing PR bond in the sum of Rs.10,000/- with one or more sureties in the like amount.

(ii) The applicant shall not tamper with the evidence or attempt to infuence or contact the complainant, witnesses or any person concerned with the case;

(iii) Applicant shall attend the concerned police station as when required by the Investigating Officer.

(iv) He shall furnish address of his residence and mobile phone number to the Investigating Officer within seven days from today.

Application stands disposed of.
