None for the Respondent. This Court has observed that notice is duly served upon the Respondent. However, the Respondent has not caused his appearance and in order to give a fair opportunity to the Respondent, the matter was adjourned.

Upon perusal of the notes of evidence, leave deserves to be granted. Hence, leave is granted. Action under Section 390 of Cr.P.C.. Respondent shall cause his appearance before the Metropolitan Magistrate, 7th Court, Dadar, Mumbai within four weeks from today and apply for bail and be released on bail subject to the satisfaction of the trial Court.

Respondent shall cause his appearance before the Learned Magistrate once in six weeks during pendency of the appeal on the date assigned by the Learned Magistrate. Upon failure to attend any two
