P.C.:- The Petition is filed apprehending Petitioner's arrest by the Respondent Nos.1 and 2 under the Customs Act, 1962. 2.

The learned counsel for the Respondent Nos.1 and 2, on instructions of the Officer concerned, who is present in the Court makes a statement that at present the Respondent Nos.1 and 2 do not propose to arrest the Petitioner and the apprehension is unfounded. Further statement is made that if the Respondent Nos.1 and 2 propose to arrest the Petitioner, then appropriate procedure established by law will be followed. Statements are accepted as undertakings to the Court.

In the light of the statements made by the Respondent Nos.1 and 2, the learned counsel for the Petitioner fairly agrees that grievance raised in the petition no more survives. Needless to mention that the Petitioner shall co-operate with the Respondent Nos.1 and 2 in investigation under the Customs Act.
