The petition is filed for transfer of investigation of the subject FIR. Mr.Yagnik, learned APP, on instructions, stated that the subject FIR is fully investigated and the Investigating Officer has come to a conclusion that the dispute raised by the petitioner is of civil nature and, accordingly, "C" Summary Report would be filed within two weeks from today. In support of his contention, he has tendered a copy of the report dated 24th July, 2017 of the ACP, Vartak Nagar Police Station, Thane. The said report is taken on record.

We have gone through the report. The report does disclose that the dispute is of civil nature. In the light of the report and the Shubhada S Kadam 1/2

17 wp 2224.15.doc statement of the learned APP, we are not inclined to entertain this petition. The same is, accordingly, dismissed. 3.
