Heard the learned Advocates for the parties including the Sarpanch of Rahatani Grampanchayat, Satara, who is present in Court and the following order is passed by consent :

(i) The order passed by the District Judge-I, Satara at Waduj dated 2nd March, 2017 which is impugned by way of the above Second Appeal is set aside. (ii)The matter is remanded back to the District Judge I, Satara at Waduj. (iii)The District Judge, I, Satara at Waduj, shall hear the Regular Civil Appeal No.524 of 2010 afresh without taking into consideration the Pursis dated 15 th February 2017 (Exhibit 21) and dispose off the Appeal, on merits, within a period of 8 weeks from the date of this order.

(iv)All contentions of the parties are kept open. ssp 1/2

sa 658 of 2017 (4).sxw (v) The parties shall appear before the District Judge, I Satara at Waduj, on th September, 2017 at 11.00 a.m., and obtain necessary directions. (vi)R and P to be forthwith returned to the District Judge, I , Satara at Waduj.
