This is an application for bringing legal heirs of sole Appellant on record. Present Application is filed within the period of limitation. It is stated that, the Appellant passed away on 11th April 2019 leaving behind him the Applicant Nos.1A to 1C as his only legal heirs and representatives.

Learned counsel for the Applicants, on instructions, submitted that, during the pendency of the present application, Applicant No.1A Smt. Sangeeta Chandrakant Kolte is also reported to be dead. She produced on record a photocopy of Death Certificate issued by the Registrar, Birth and Death Registration Officer, Grampanchayat Raipatan, Taluka Rajapur, District 1/2

Osk 13-Cas-1472-2019.odt Ratnagiri and seeks leave to delete name of Applicant No.1A from the array of Applicants from the application and prayer Clause. Leave granted.

Amendment in the present application be carried out forthwith. 3.

In view thereof and for the reasons stated in the Application, Application is allowed in terms of prayer Clauses (a) and (b). Necessary amendment in the Second Appeal be carried out within a period of three weeks from today.
