IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION ANTICIPATORY BAIL APPLICATION NO.973 OF 2018 Siddharth Vasant Dhanu ... Applicant V/s.

The State of Maharashtra ... Respondent WITH CRIMINAL APPLICATION NO.666 OF 2018 (INTERVENTION APPLICATION) IN ANTICIPATORY BAIL APPLICATION NO.973 OF 2018 Suresh Gulabchand Parmar ....Intervener In the matter between :- Siddharth Vasant Dhanu ... Applicant V/s.

The State of Maharashtra ... Respondent ---- Mr. Dinesh Kadam i/b. MZM Legal for the Applicant. Smt. Rutuja Ambekar, APP for the Respondent State. Mr. Kapil Dave for the Original Complainant/Intervener. CORAM : A.S.GADKARI, J.

DATE : 30th JULY 2018 P.C.:

1.

The applicant had given schedule of payment to be deposited 1/3

in the Registry of this Court, and therefore, the interim relief granted to the applicant by an Order dated 11.05.2018 was extended till 28.06.2018.

2.

On 29.06.2018, learned counsel appearing for the applicant made a submission that, due to some financial difficulties, the applicant could not comply with the Order dated 07.06.2018, however, at the request of learned counsel for the applicant, period to deposit the said amount was extended upto 18.07.2018. It was specifically observed in the Order dated 29.06.2018 that, if the applicant fails to deposit the said amount on or before 18.07.2018 in the Registry of this Court the interim relief will be vacated on that count alone. On 20.07.2018, again at the request of learned counsel for the applicant, period to deposit the said amount was further extended till today.

3.

Learned counsel appearing for the applicant, today on instructions expressed inability of the applicant to deposit the said amount. Thus, it is clear that with a view to procure interim relief, the applicant made the said statement expressing his desire to deposit the amount allegedly involved in the crime in the Registry of this Court and further made a statements only with a view to get 2/3

extension of the said interim relief.

4.

In view thereof, interim relief granted by an Order dated 11.05.2018 is hereby vacated and as a consequence thereof, application is dismissed.

In view of disposal of the Anticipatory Bail Application, Criminal Application No.666 of 2018 does not survive and the same is accordingly disposed off.
