The challenge in the petition is to the order dated 06/05/2022 passed by the sub-divisional ofÏcer in RTS Appeal no. 76 of 2022 in which prayer of the petitioner for grant of stay to the mutation entry came to be rejected.

The fact that the suit proceedings at the behest of the petitioner based on the will dated 14/12/2020 is pending, so also the claim of the petition under section 2 of Bombay Regulation Act for administration of the property is also sub judice. 3.

A prayer is made for withdrawal of the present petition. 4.

The Petition stands disposed of as withdrawn. 5.

However, hearing of the aforesaid RTS Appeal no. 76 of 2022 akn Corrected pursuant to speaking to minutes of order dated 18/08/2022

Apart from above, if the petitioner takes out application for grant of temporary injunction during the pendency of the aforesaid title suit, same be decided without being influenced by dismissal of the present petition or order impugned passed by the Circle OfÏcer.
