The petitioner has impugned the order dated 17th January, 2014 passed by the learned 4th Joint Civil Judge, Junior Division, Nashik on the application filed by the defendants under section 9-A read with under Order XIV Rule 2 of the Code of Civil Procedure, 1908.

In view of deletion of section 9-A of the Code of Civil Procedure, 1908, the said issue framed by the learned Trial Court on the issue of period of limitation would be tried as one of the issue along with other issues under Order XIV Rule 2 of the Code of Civil Procedure, 1908.

The writ petition is disposed of in aforesaid terms. There shall be no order as to costs.
