Heard learned counsel for the parties.

By this application, the applicant seeks his release on temporary bail for a period of 45 days for appearing for S.Y.B.A. examination, which is scheduled to take place from 25th June 2022. 3.

Learned APP on instructions states that Yerwada Central Prison, has a Center for Examination and that approximately 23 N. S. Chitnis 1/2

6-ia.1680.2022.doc prisoners would be appearing for the examination which is to be held by Yashwantrao Chavan Open University. She further submits that the applicant is not required to attend the examination elsewhere i.e. at Malshiras. Learned APP has tendered a letter sent by the Superintendent, Yerwada Central Prison, to the learned APP dated 22nd June 2022, wherein it is stated that Yerwada Central Prison, has been designated as a Center for holding examination of the Yashwantrao Chavan Open University. The said letter is taken on record. 4.

Considering the statement made by the learned APP, the question of granting temporary bail to the applicant does not arise. It is open for the applicant to appear for S.Y.B.A. examination in Yerwada Central Prison, which is designated as a Center for holding examination of the Yashwantrao Chavan Open University. 5.

Interim Application is dismissed and accordingly disposed of.
