Mendadkar, Advocate, after arguing the matter at considerable length, when we were inclined to dismiss the same on the ground of availability of alternate remedy, prays for withdrawal of the petition so as to take recourse to the alternate efficacious remedy available in law. Permitted to be withdrawn with liberty as prayed for. Needless to state that since the present Petitioner was under erroneous legal advise bonafidely prosecuting the present Petition, the Petitioner would be entitled to the benefit of Section 14 of the Limitation Act for the delay in filing the Appeal before the Appellate Authority.
