Having heard Mr.Shetye, we find that the Chief Election Officer has merely made a recommendation, but has not imposed any penalty. It is merely a recommendation which may or may not bind the employer. The employer-Pimpri Chinchwad Municipal Corporation has presently not taken any action. As and when any such action is taken or initiated, these petitioners can point out that the recommendation of the Chief Election Officer should not bind the employer. That the order impugned in this petition is merely a recommendation and it by itself does not impose any penalty leading to any adverse remarks being entered into their service books.

Leaving all such contentions open, we dispose of the writ petition. The wording in the last two lines of the impugned order should not be taken and construed as imposition of penalty, but merely a recommendation.
