The learned APP, upon instructions, submits that the trial in Sessions Case No. 398 of 2015 is in progress. The prosecution has recorded the examination-in-chief of the complainant and the crossexamination is to be conducted on 4th February, 2017. In the midst of the trial, it would not be appropriate to consider an application under Section 439 of Cr.P.C. Hence, the application stands disposed of, however, the learned Sessions Judge seized with Sessions Case

Yadav V.G. 2 23.ba.1098.16.odt. No. 398 of 2015 is requested to expedite the trial, as far as possible and not grant unwarranted adjournments to the prosecution or the complainant assisting the prosecution. Application stands disposed of.
