Applicant is seeking pre-arrest bail in Crime No.122 of 2022 registered with Baramati City Police Station, District - Pune for the offences punishable under Sections 328 r/w. Section 34 of the IPC as also Sections 65(f) and 65(e) of the Bombay Prohibition Act. 2.

The contention of counsel for applicant is that the provisions of Section 328 of IPC are not attracted as necessary ingredients thereof cannot be inferred from the contents of the FIR. That being so, the applicant deserves to be released on pre-arrest bail. 3.

Learned APP would oppose the prayer.

It appears that the applicant and his other relatives are shown to have been involved in similar type of offences. 5.

Apart from the above, the investigation depicts the prima facie involvement of the applicant in crime in question which warrants custodial interrogation.

That being so, no case for grant of pre-arrest bail is made out. Application fails and the same is rejected.
