By this application, the applicant seeks pre-arrest bail in connection with C.R. No. 5 of 2018 registered with the Santacruz Police Station, Mumbai, for the alleged offence punishable under Sections 15(1), (2) of the Environment Protection Act.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the said case. He submits that there is no destruction of mangroves on Survey no. 1213 as alleged by the Talathi.

On the last date, the learned APP sought time to take instructions with respect to the above.

Today, learned APP has tendered a letter dated 11th April, 2018 of the Range Forest Officer, M.M.C.U. West Mumbai. The said letter is taken on record and marked as "X" for identification. According to the said letter, there is no destruction of mangroves on Survey no. 1213, as alleged by the Talathi. 6.

In view of the aforesaid and the letter dated 11th April, 2018 of the Range Forest Officer, M. M. C. U., West Mumbai, the Application is allowed, and the applicant is granted pre-arrest bail, on the following terms and conditions :

ORDER

(i) In the event of the arrest, the applicant be enlarged on bail on furnishing P.R. Bond in the sum of Rs.10,000/-, with one or two sureties in the like amount.

(ii) The applicant shall report to the concerned police

station on 17th and 18th June, 2019 from 10.00 a.m. to 12.00 noon.

(iii) The applicant shall inform his latest addresses and mobile contact number and/or change of residence or mobile details, if any, from time to time, to the concerned Police station, in writing. 7.

The Application is accordingly disposed of.
