Learned AGP on instruction states that the Vigilance Committee has though conducted enquiry has yet to submit the report to the respondent no.2-Scrutiny Committee for consideration. He submits that only after such report is received from the Vigilance Committee, the Scrutiny Committee after completing the procedure would be able to decide the application for caste claim made by the petitioner. 2.

Learned AGP seeks four weeks time to complete the procedure and to pass an appropriate order. In our view, the request of the learned AGP is reasonable. The order shall be passed by the Scrutiny Committee within four weeks from today, without fail and shall communicate the said order within one week from the date of passing of such order. If the order is adverse against the petitioner, the petitioner would be at liberty to file appropriate proceedings. If the

bdp 11-wp-8116.21.doc order is in favour of the petitioner, Caste Validity Certificate shall be issued within one week from the date of passing of such order. 3.

Writ Petition is disposed of in aforesaid terms. There shall be no order as to costs.

It is noticed by this Court in large number of matters that the petitions are filed impugning the order of Caste Scrutiny Committee belatedly. During the pendency of the petition, the students apply for admission in one or the other course and press for urgent hearing by giving them priority on the ground that the last date for submitting Caste Validity Certificate before the CET Cell would be expiring within one or two days. We deprecate such strategy on the part of such students.
