INTERIM APPLICATION NO.12940 OF 2023:

By moving this Interim Application, the applicants are seeking intervention in the proceedings of this writ petition stating therein that in case prayers in the writ petitions are granted, that will directly affect promotional prospects, seniority etc. of the applicants or their members.

In para 6 of the application, it has been stated that some of the members of the applicants had moved their application seeking intervention in the proceedings of the Original Application before the Central Administrative Tribunal (hereinafter referred to as "the Tribunal"), however, they were not allowed to be impleaded as respondents. The applicants who did not move for being impleaded in the proceedings of the Original Application before the Tribunal have now sought intervention in the proceedings of this writ petition. Once the applicants did not make any application seeking intervention in the proceedings of the Original Application before the Tribunal, their intervention in the proceedings of the present writ petition, in our opinion, is not warranted.

It is also to be noticed that certain members of the applicants had moved the Tribunal seeking their intervention in the proceedings of the Original Application before the Tribunal, however, such prayer was not accepted, but said members of the applicants did not challenge the said order of the Tribunal.

In the above circumstances, the Interim Application is rejected.
