1. Mr. Dhanuka, the learned advocate for the petitioner states that he has instructions to withdraw the petition. Mr. Runwal, the learned advocate for respondent No.1 submits that the obvious reason for withdrawal of the petition is the apprehension, that petitioner will have to deposit the arrears of maintenance in the Court. He, therefore, requests that if the petition is allowed to be withdrawn, costs of the petition or litigation expenses be awarded to the respondent, since she had to engage an advocate and appear in the matter. There is no dispute that petitioner is in arrears of maintenance and that the petition is for challenging the order of maintenance. In the circumstances the petition is allowed to be withdrawn with a direction that the petitioner shall pay a
