DATE: 03 JULY 2015 P.C. :- 1] Heard Ms Furtado - applicant no. 1 appearing in person and Ms Patil, the learned counsel for the respondent.
2] By this civil application, the applicants without prejudice to their rights and contentions in the CRA instituted by them, seek leave to deposit rent and arrears. 3] There is no reason to disallow such an application. Accordingly, the civil application is allowed in terms of prayer clause (a). This shall of course be without prejudice not just to the rights of the applicants but also the rights of the respondent.

skc 14-CAC-522-14 4] Further, in case the respondent desires, they are, again without prejudice to their rights and contentions permitted to withdraw the amounts so deposited. Such withdrawal shall abide by any final orders that may be made in the revision application. In fact, it is to be noted in this civil application itself, the applicants had prayed that the respondent be permitted to withdraw the rent as deposited. 5] Arrears of rent shall be deposited in the Small Causes Court as per the existing account or, if necessary a new account, within a period of six weeks from today. 6] Civil application is disposed of in the aforesaid terms. 7] All concerned to act on basis of an authenticated copy of this order.
