Heard learned Counsel for the parties.

By this application, the applicant seeks pre-arrest bail in connection with C.R. No. 516 of 2016 registered with the Kothrud Police Station, Pune, for the alleged offences punishable under Sections 406, 420, 467, 468, 120B r/w 34 of the Indian Penal Code.

Learned Counsel for the applicant states that the only allegation as against the applicant is that he introduced the complainant to co-accused - Dr.Sandesh Pokale, whereas the amounts were paid by the complainant directly to Dr.Sandesh Pokale. He submitted that there is nothing in the entire transaction to show the complicity of the present applicant. He submitted that infact the applicant and the complainant are friends for last 15 years and as such there was no intention on the part of the applicant to cheat the complainant.

Learned Counsel for the Respondent No.2 does not dispute the fact, that the only allegation as against the applicant is that he introduced the complainant to co-accused - Dr.Sandesh Pokale. He states that the amounts were paid by the complainant to Dr.Sandesh Pokale. The complainant is present in Court. He states that he has no objection if the applicant is granted pre-arrest bail.

Considering the statement made by the complainant and the applicant's role, the application is allowed and the applicant is granted prearrest bail on the following terms and conditions :

ORDER

(i) In the event of the arrest, the applicant be enlarged on bail on executing P.R. Bond in the sum of Rs.15,000/- with one or two sureties in the like amount.

Learned Counsel for the respondent no.2 states that he will file his 'Vakalatnama' on behalf of the respondent no.2, in the course of the day. The statement is accepted.

The Application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the observations made herein are prima facie and are confined to this application.
