This is an application received through Jail. 2.

Heard the learned APP.

The applicant has made a grievance that despite the order of bail granted by this Court dated 24.2.2016 in her favour she could not avail the bail as she hails from lower economic strata of the society and is unable to furnish solvent local sureties to make up the bail amount of Rs.25,000/-. She therefore, prayed that she may be released on cash bail.

In view of the fact that, despite the order dated 24.2.2016 by this Court the applicant could not avail the bail and is languishing in jail and for the reasons stated in the application I am inclined to modify the said condition.

a) The applicant is permitted to furnish cash bail of Rs.25,000/- instead of sureties as directed by Order dated 24.2.2016.

b) Rest of the conditions imposed upon the applicant by Order dated 24.2.2016 are not disturbed.

c) Application is allowed in the aforesaid terms. d) The learned APP is directed to communicate this Order to the Superintendent Mumbai District Women Prison, Byculla, Mumbai by all possible modes.

All the concerned to act on a copy of this Order duly authenticated by the registry of this Court.
