Heard the learned counsel for the Applicant. After arguing at length, the learned counsel for the Applicant, upon instructions, seeks liberty to withdraw the application. The learned counsel for the Applicant submits that the Applicant would appear before the concerned Magistrate on or before 12th June, 2018 and file an application under section 437 of Criminal Procedure Code, which shall be considered on its own merits. 2.
Application is allowed to be withdrawn and disposed of accordingly. The Applicant stands protected till 5.00 p.m. of 12th June, 2018. In the eventuality, the applicant does not appear before the Magistrate or the concerned police V.A. Tikam 1/2
station on or before 12th June, 2018, the Bundgarden Police Station is at liberty to arrest the Applicant. The Learned Magistrate shall consider the application on its own merits and shall not be influenced by the fact that the application filed under section 438 of the Cr.P.C. is withdrawn. [SMT.
