By this petition filed under Article 226 of Constitution of India, the Petitioners are seeking to quash and set aside the FIR bearing CR. No.36/2015 registered with Trambakeshwar Police Station, District Nashik for the offences punishable under sections 454, 457 and 380 read with 34 of the Indian Penal Code, 1860.

It is not disputed that pending this writ petition, the charge sheet has been filed in the subject crime and the learned JMFC has framed charge against the Petitioners. That apart, having gone through subject FIR, we are prima facie of the opinion that offence as alleged in the FIR, is disclosed. In that patilsr 1 / 2

view of the matter, we are not inclined to entertain this writ petition. Consequently, writ petition is dismissed. 3.

The trial Court shall not be influenced by the observations made hereinaobve.
