Heard learned Counsel for the applicant.

The learned counsel for the applicant submits that during the pendency of present Civil Revision Application, S.C. Suit No. 5823 of 2006 filed by respondent plaintiff stands dismissed.

Thereafter, the respondent plaintiff filed First Appeal in this Court and same is pending. He submits that in view of subsequent development, nothing survives in Civil Revision Application. He submits that applicant may be permitted to withdraw Civil Revision Application. To that effect, he has given in writing on farad. Same is taken on record and marked "X" for its identification. Same is permitted.

Civil Revision Application stands dismissed as withdrawn. No order as to costs.
