ORDER :

Heard learned Counsel for parties.

Pursuant to the order dated 11th October, 2021, the parties have agreed to appoint a Sole Arbitrator for which the Respondents have also taken necessary instructions and given their consent.

Learned Counsel for the parties have agreed to the 1/3

appointment of Shri S.S. Bansal, ADG to act as Sole Arbitrator to decide the disputes arising out of the Contract bearing C A No.CEPZ/ DEO/88 of 2007-2008 for "Provision of KLP ACCN (Phase-II) CATS Nashik" between the Petitioner and the Respondents. 4.

In view thereof, following order is passed:- (i) Shri S.S. Bansal, ADG, Sole Arbitrator, Office of the ADG is appointed as a Sole Arbitrator to decide the disputes between the Petitioner and the Respondent arising out of the Contract bearing C A No.CEPZ/DEO/88 of 2007-2008 for "Provision of KLP ACCN (Phase-II) CATS Nashik" between the Petitioner and the Respondents.

(ii) The venue of arbitration shall be in Pune.

(iii) Office to inform the Sole Arbitrator regarding her appointment.

(iv) The Sole Arbitrator is requested to file her Disclosure Affidavit of Arbitration under Section 11(8)(i) of the Arbitration 2/3

and Conciliation Act, 1996 within a period of three weeks from the date of receipt of the notice issued by the Registrar Judicial-I and provide copies to the parties.

(v) Parties to appear before the Sole Arbitrator on the date fixed.

(vi) The fees of the Sole Arbitrator will be borne equally by the parties.

(vii) Arbitration Petition Nos. 70 and 71 of 2021 are disposed of in the above terms.

(viii) No costs.
