Heard the learned counsel for the parties.

By this petition under Article 227 of the Constitution of India the Petitioner challenges the order dated 6.5.2016 passed by Shop Inspector, Sangli cancelling the petitioner's Shop & Establishment Licence No.2224 IV.

After arguing for some time, the learned counsel for the petitioner seeks permission to withdraw the petition with liberty to file afresh application for new licence. He submits that if application is filed by the petitioner for new licence, same be considered by the authority on its Mohite 1/2

3 wp8217-16 own merits without influencing the present litigation.

Considering the submissions made by the learned counsel for the petitioner and as the petitioner give in writing on farad for withdrawal of the present Writ Petition, I am satisfied that the petitioner has made out a case for liberty to apply for fresh licence. Hence, following order is passed: a) Writ Petition stands disposed of as withdrawn.

b) No order as to costs.

c) Liberty granted to the petitioner if he so desires to apply for fresh licence and that be decided on its own merits by the authority without influencing the present litigation.
