DATED:- 12th OCTOBER, 2023 PC:- 1) Heard the learned Counsel for the applicant and the learned APP for the State.
2) By an order dated 19th May, 2023, this Court was persuaded to grant interim bail. It was, inter alia, noted that the applicant was not named in the FIR and the name of the applicant emerged for the first time in the third remand report. 1/2
28-ABA-1444-23.DOC 3) The learned APP submits that the applicant pursuant to the order passed by this Court, had appeared before the Investigating Officer. The charge-sheet has also been filed on 22nd February, 2023.
4) In the aforesaid view of the matter, since the applicant has co-operated with the investigation and the investigation is complete for all intent and purpose, further custodial interrogation of the applicant does not seem warranted. 5) I am, therefore, persuaded to make the order of interim bail absolute.
6) The order of Interim Bail dated 19th May, 2023 is made absolute on the terms and conditions incorporated therein. 7) The applicant shall henceforth appear before the Investigating Officer as and when directed.
8) The applicant shall regularly attend the proceedings before the jurisdictional Court.
9) The application stands disposed.
