The subject matter of the Writ Petition is Godown viz.Ishant Enterprises, Survey No.83/1/1, Sandbhorwasti, Kiwle, Pune. 2.

It is the case of the Petitioner that though notices under MRTP or Maharashtra Municipal Corporation Act have been issued to adjoining structures, no notice has been issued to the Petitioner. The apprehension of the Petitioner is that his structure may be demolished. Learned Counsel for the Petitioner states that the Petitioner will be filing Regularisation Application within three weeks.

In respect of adjoining structures, where notices have been issued, we have passed orders allowing the Petitioners to file Regularisation Applications. In the facts and circumstances of the case and in the interest of justice, we dispose of the Petition by passing the following order:

O R D E R

(i) We record the statement of the learned Counsel for the Petitioner that the Regularization Application shall be filed online by the Petitioner within three weeks from today;

(ii) If such Regularization Application is filed, the same shall be disposed of by the Respondent-Corporation expeditiously and the decision on the same shall be communicated to the Petitioner. (iii) Until the Regularization Application is decided and for a period of two weeks from the date of communication of the decision to the Petitioner on the Regularization Application, no coercive steps shall be taken against the structure of the Petitioner. 4.
