Heard Mr. N. R. Gandhi, learned counsel for the applicants and Mr. Kaival Shah, learned counsel for respondents no.1 to 7. Mr. Gandhi orally prays for deleting respondents no.1 and 14. He further states that respondent no.12 died on 6.3.2014, leaving behind (i) Shakuntala Ramdas Korde, (ii) Rajaram Ramdas Korde, (iii) Dattatraya Ramdas Korde and (vi) Ravindra Ramdas Korde.

Pending hearing of this application, even Shakuntala Korde died. He submitted that the legal representatives of

2/2 CAS/915/2014 respondent no.12 are duly served.

In view thereof and for the reasons stated in the application, Civil Application is allowed in terms of prayer clauses (a), (b) and (c), except respondent no.12(i)-Shakuntala Korde, with no order as to costs. Deletion of respondents no.1 and 14 is at the risk of the applicants.

Amendment in the main Appeal shall be carried out within 14 days from today.
