This application is filed by an accused involved in Crime No.I-267/2015 registered by Manpada Police Station for the offences punishable under Sections 366A and 354 read with Section 34 of the IPC and Sections 3, 7, 16 and 18 of Prevention of Children from Sexual Offences Act and under Section 3 of Maharashtra Prevention and Eradication of Human Sacrifice and other Inhuman Evil and Aghori Practices and Black Magic Act. avk 1/3

Perused the copy of charge-sheet annexed with the application along with statement of victim girl Kumari Nafisa Khan recorded under Section 164 of the Code of Criminal Procedure wherefrom involvement of the applicant in the present crime is clearly established.

Though learned counsel for the applicant has stressfully submitted that all other co-accused in the matter are released on bail by the trial court, the role of the applicant since is entirely different and since he appears to be the brain for commission of the said offence, the applicant is not entitled for being released on bail, even after imposing conditions. However, as the charge-sheet is stated to be filed, following order is passed to meet the ends of justice. The learned Sessions Judge who is seized of the matter being Special Case No.91 of 2015 shall make an endeavour to dispose of the said case within a period of one year from the date of receipt of Writ.
