P. C. :- 1) The petitioner seeks the directions to respondent No.4 to disclose the information as directed by the Respondent No.2Information Commissioner. The learned Counsel for the petitioner submits that in spite of the directions issued by the Respondent No.2- Information Commissioner, respondent No.4 (Junior Engineer, Town Planning Department, Ulhasnagar Municipal Corporation) has failed to provide the necessary information to the petitioner. In fact, the Information Commissioner passed order invoking the powers under Section 20 (1) and 20 (2) of the Right to Information Act, 2005 (for short, "the R.T.I.Act, 2005).

2) It is the petitioner's contention that in spite of invoking

2/2 13-wp-6931-17.doc the powers under Section 20 (1) and (2) of the RTI Act, 2005, the respondent no.4 is not furnishing the necessary information to the petitioner.

3) Without expressing any opinion on the merits of the case, we observe that the petitioner would bring this to the notice of the Information Commissioner and also to inform the Deputy Municipal Commissioner, Ulhasnagar Municipal Corporation being the First Appellate Authority under the RTI Act, 2005. 4) The Writ Petition is disposed of in the aforesaid terms.
