This is an application for modification of the order dated 2.7.2021 passed by this Court (Coram: Prakash D. Naik, J.). Vide that order, the Court had recorded that the Court was not inclined to grant relief and, therefore, the application was allowed to be withdrawn at the request of learned Counsel for the applicant. The order goes on to mention that the applicant was permitted to surrender before the investigating officer on 5.7.2021 at 11:00 a.m. 2.

The time granted to the applicant to surrender is already over by two weeks. He has not surrendered. No cogent reason is mentioned in the application. 4.

Shri Marwadi, learned counsel for the applicant states that the applicant is suspected of suffering from COVID-19. This also is no ground to extend the period for surrendering. If the applicant is suffering from such infection, the investigating officer will, of course, take necessary precaution according to protocol. Since no case is made out for extension of that time, the application is dismissed.
