It is submitted by the learned counsel appearing for the Petitioner that the Petitioner is running 8th to 10th standards classes and it desires to start 5th standard class. Accordingly, a proposal was submitted to the Education Committee, Zilla Parishad, Pune, on 01st November, 2008 which is pending. It is further submitted that the Respondent No. 4 had issued a notice to the Petitioner to close the school, as requisite permission was not granted to it.

Without expressing any opinion on merits of the matter, we observe that the Petitioner is at liberty to file a fresh application before the appropriate authority. In case, such an Borey 1/2

spb/ 28wp6778-13.doc application is filed, the authority concerned shall deal with the same and take appropriate decision on its own merits at the earliest and, in any case, within three months from the date of receipt of the application from the petitioner. With the above observation, the Petition is disposed of.
