This is an application for condonation of delay and extension of time by six weeks to dispose off the application of the petitioner as per order dated 5.12.2014, from the date of disposal of the present application. 2) Mr. Jetly, the learned counsel appearing for the applicant submitted that by an order dated 5.12.2014 the Joint Commissioner of Customs, Nhava Sheva, District Raigad was directed to decide an application of the petitioner herein for return of property within a period of 12-weeks from the date of passing of the said order. He submitted that the period of 12 weeks came to an end on 4.3.2015. He further submitted that as a matter of fact the concerned authority decided the said application and passed the necessary order on 23.6.2015. The present application was filed on 11.6.2015 and since then it was pending.

3) In view of the fact that, the application has been decided on 23.6.2015, though belatedly and for the reasons stated in the application and in the interest of justice, the delay caused at the instance of respondent No.1-Dy. Commissioner of Custom is hereby condoned. The application as of today has become infractuous and the same is disposed of accordingly. (A.S. GADKARI, J.)
