Sawant under Section 304 B read with 34 of the Indian Penal Code, 1860 applicant is seeking prearrest bail. Applicant - mother-in-law of the deceased, is 60 year old lady. Complainant is

2/3 mother of the deceased. Deceased died otherwise than under the normal circumstances. She committed suicide. Her husband came to be arrested and against whom the charge-sheet has been filed.

It appears, the applicant is living with another son separately. In other words, deceased and the husband were living in independent house since after their marriage. The only allegation against the applicant is that, in the month of September, 2020 she had demanded Rs.20 lacs from the deceased, for purchasing flat. Barring this allegation, the First Information Report or such other material collected in the course of investigation, does not suggest that the applicant was ever harassing the deceased, with the view to meet her unlawful demand.

Even otherwise, the applicant was granted prearrest protection by this Court by interim order dated 27 th November,2020.

3/3 Learned Additional Public Prosecutor on instructions fairly submits that prima facie, there is no material to show complicity of the applicant in the accusations alleged against her.

Applicant is therefore granted bail and hence the order:- (i) In the event of arrest of the applicant in Crime No.I-240 of 2020 registered with Shivaji Nagar Police Station Ambernath (E), she shall be released on bail on executing PR bond for the sum of Rs.20,000/- (Rs. Twenty Thousand Only) with one or more sureties in like sum.

(ii) The applicant shall report to the investigating officer as and when called for.
