Heard the learned counsel for the applicant. This is an application under Section 439 of Cr.P.C. The applicant herein is arrested in March, 2016 in Crime No. 16 of 2016 registered at Kasa Police Station, Dist. Palghar. The application seeking enlargement on bail was rejected by the Sessions Court, Palghar on 6.5.2016.

The learned APP submits that during the pendency of this application, the investigation is completed and charge-sheet is filed on 19.8.2016.

In view of this, the learned counsel for the applicant seeks

Mhi 2 BA-1114-16.sxw liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice with further liberty to approach the Sessions Court under Section 439 of Cr.P.C. in the changes circumstances. The learned Sessions Court shall consider the application on its own merits without being influenced by the withdrawal of the present application. Application stands dismissed as withdrawn.
